Terms of Service
These terms govern your use of ScanKit, a web app that gives digital PDFs a printed-and-scanned or phone-photo look and turns photos of documents into clean scans. By using the app or the website, you agree to them. If you do not agree, please do not use the service.
1. Who we are
ScanKit is operated by 62004027611 SOLE PROPRIETOR ("we", "us"). You can reach us at [email protected] or through our contact page.
2. Eligibility
You must be at least 18 years old and able to enter a binding contract to use ScanKit. If you use it on behalf of a company or other organisation, you confirm that you are authorised to accept these terms for it.
3. The service
ScanKit lets you turn a PDF into a "printed and scanned" or phone-photo look, turn a photo of a document into a cleaned-up scan, and add your own signature or handwriting with the Ink Studio. It also offers saved templates and an eraser.
Your documents are processed in your browser and are not uploaded to our servers. Our server only decides whether a download is allowed and checks your subscription with PayPal. To work, the app loads some components from other providers: handwriting fonts from Google Fonts when you open the Ink Studio, and PayPal's checkout when you subscribe. Our Privacy Policy lists exactly what each of them and our server receive.
On the free plan, on-screen previews carry a "preview" watermark. Downloaded PDFs do not.
We may add, change or remove features. We will give notice before a change that significantly reduces what a paying subscriber receives.
4. Free downloads
Without a subscription you can download up to two PDFs a day on each device, and no more than three a week from one internet connection, whichever limit you reach first.
- A "device" means one browser that holds our device cookie. A different browser, or the same browser after its cookies are cleared, counts as a new device.
- An "internet connection" means one IP address. People sharing a network, such as a home, office or public Wi-Fi, share the weekly limit.
- The daily limit resets at 00:00 UTC. The weekly limit resets on Monday at 00:00 UTC. The app shows when your next free download becomes available, in your local time.
- Unused free downloads do not carry over.
You are free to clear your cookies at any time. Doing so, switching networks, or using automated tools in order to get more free downloads than this allowance is not permitted.
We may change the free allowance. The current allowance is always the one shown on this page and in the app.
5. Subscription and automatic renewal
A subscription costs $4.99 / month and removes the download limit. It is billed and collected by PayPal, not by us, and PayPal's own terms apply to the payment.
- It renews automatically. PayPal charges $4.99 / month when you subscribe and again every month after that, until you cancel.
- You cancel in PayPal. Removing the app, clearing your browser data or simply not using ScanKit does not stop the payments. Step-by-step instructions are on the Cancellation and Refunds page.
- Access after cancelling. When you cancel, no further payments are taken and you keep unlimited downloads until the end of the month you have already paid for.
- Devices. One subscription can be used on up to three devices (browsers). To use it on another browser, choose "Restore" in the app and enter your PayPal subscription ID and PayPal email. A browser whose cookies have been cleared counts as a new device. If you reach the limit, write to us and we will reset the devices linked to your subscription.
6. Price changes
We may change the subscription price. If we do, we will tell you before the new price applies to your subscription, so you can cancel first. If PayPal requires your approval for a price change, the new price applies only once you approve it.
7. Refunds and your right to withdraw
Payments are not refunded for a part of a month, including when you cancel partway through. Our refund approach, including a 7-day window in which you can ask us to review a charge, is set out on the Cancellation and Refunds page, which forms part of these terms.
If you are a consumer in the EU or UK, you may have a legal right to withdraw from the subscription within 14 days of first subscribing. How to use it is explained on the Cancellation and Refunds page. Nothing in these terms reduces rights that you have under mandatory consumer law.
8. Acceptable use
You must follow our Acceptable Use Policy, which forms part of these terms. In short: use ScanKit only for your own documents and documents you are authorised to handle, sign only with your own signature or one you are authorised to apply, and never use it to forge, alter or fabricate documents, IDs, receipts or records, or to deceive anyone.
9. Your content
Your documents, photos, signatures and templates remain yours. They stay on your device: we do not receive them in the normal operation of the service, and we claim no ownership of them. You are responsible for having the right to process any document you use with ScanKit and for how you use the output.
Templates and saved signatures are kept in your browser's storage on your device. If you clear that storage or switch devices, they are lost, and we cannot recover them. You can export your templates to a file from the app to keep a copy.
10. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use ScanKit for its intended purpose while you comply with these terms. All rights in the app, its code, design and branding remain with us or our licensors. You may not:
- copy, modify, or create derivative works of the app or its code, except where the law gives you that right despite this restriction;
- scrape, crawl or systematically extract content from the site or app;
- reverse engineer, decompile or attempt to extract the source of the app, or bypass its payment or usage limits, except where the law gives you that right despite this restriction;
- resell, sublicense or offer the service to third parties.
Third-party components, such as the PDF engine and the web fonts, remain subject to their own licences.
11. What the output is, and is not
ScanKit is an image-processing tool. It is not a certified electronic signature provider, notary, trust service or identity-verification service. We do not promise that any document you produce will be accepted by any recipient, court, authority or institution, or that it has any particular legal effect. If a recipient requires an original, a certified copy or a particular type of signature, you must supply one.
The output imitates the look of a scan or photo. It is not guaranteed to be indistinguishable from one, and a careful recipient may be able to tell how it was made. Downloaded PDFs contain only page images. They do not contain any scanner or camera information, and the file name we suggest starts with "scan-" followed by the date and time. Do not tell a recipient that a file is something it is not.
12. Disclaimers
The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the service will be uninterrupted, error-free or produce results suited to your needs. Output quality depends on your input files, your browser and your device, and the service depends on providers we do not control, such as PayPal and the content networks listed in section 3. Check every file before you send it to anyone.
Nothing in these terms limits rights that you have as a consumer under mandatory law, including rights if the service is faulty or not as described.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or opportunity, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or, if you have not paid anything, to 50 USD.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for wilful misconduct.
14. Indemnity
You agree to compensate us for claims, losses, liabilities and reasonable costs (including reasonable legal fees) arising from your breach of these terms or of the Acceptable Use Policy, or from your use of the service to process or produce a document in a way that infringes someone's rights or breaks the law. This does not apply to the extent that mandatory consumer law gives you greater protection.
15. Suspension and termination
We may suspend or end your access if you breach these terms or the Acceptable Use Policy, if we reasonably suspect misuse or fraud, or if the law requires it. Where it is reasonable to do so, we will tell you why. If we end a subscription because of your breach, no refund is due for the remaining period. If we end it for any other reason, we will refund the unused part of the period you paid for. While a PayPal dispute or chargeback about a payment is open, we may pause access for that subscription.
You may stop using the service at any time; to stop payments, cancel in PayPal. Sections that by their nature should survive termination, including 9 to 14 and 17, will survive.
16. Changes to these terms
We may update these terms. The date at the top shows the current version. For material changes we will give reasonable notice on the site or in the app before they take effect. If you keep using the service after the effective date, you accept the updated terms. If you do not accept them, cancel your subscription and stop using the service.
17. Governing law
These terms, and any dispute arising from them, are governed by the laws of the place where 62004027611 SOLE PROPRIETOR is established, without regard to conflict-of-law rules, and the courts there have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and any right to bring a claim in its courts.
18. General
If a provision of these terms is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a transfer of the business, as long as your rights are not reduced. These terms, together with the Privacy Policy, the Cancellation and Refunds page and the Acceptable Use Policy, are the whole agreement between you and us about the service.
